Guilty plea in Medicaid fraud

A Worcester pharmacy owner pleaded guilty yesterday in Suffolk Superior
Court to taking $5,000 and filing false claims for payment from the
Medicaid program.

Attorney General Scott Harshbarger's office said Theodore Ronald Zive of
82 Newton Ave. North was sentenced by Judge Charles Grabeau to a
one-year suspended sentence in the House of Correction and ordered to
perform 150 hours of community service and pay $30,000 in fines,
penalties and restitution. Zive pleaded guilty to charges against him
and the former University Pharmacy of 15 counts of filing false Medicaid
claims and one count of larceny over $250.

According to Harshbarger's office, between March 1990 and June 1993,
Zive and University Pharmacy billed the Medicaid program for
prescription drugs and durable goods that were never provided to the
Medicaid recipients named on the bills. Zive and University Pharmacy
substituted cheaper generic drugs when filling brand name prescriptions
for Medicaid recipients, but billed the Medicaid program for the more
expensive brand-name drugs. He also intentionally provided false
information to the Department of Public Welfare when submitting invoices
for payment, according to the attorney general.

"Although the actual amount of funds stolen is not large, this case
represents flagrant abuse of the Medicaid system," Harshbarger said.
"When a provider of Medicaid services defrauds the system, regardless of
the amount of the loss, the taxpayers of the commonwealth pay."

793 Yes his son-in-law, Boruch Modechai Garfunkel, did remarry Betty Volaski after the death of Rabbi Ash?s daughter. They lived in Savannah, Ga. where they raised their family. There is a book written by Milton Gottesman which was published by the American Jewish Historical Society in New York titled ?Hoopskirts and Huppas ? A Chronicle of the Early Years of the Garfunkel-Trager Family in America 1856-1920? which provides some details of the family history. I do not believe that I am related to the david-davidson family. I am a great-grandchild of Boruch Modechai Garfunkel. Garfunkel, Benjamin (Baruch) Marcus (I8724)
